What Is Felony DWI?

A DWI is usually a misdemeanor. However, certain scenarios can elevate the crime to a felony.

Aggravating factors include:

  • Three or more DWI charges 
  • The DWI resulted in a serious injury or death
  • At the time of the offense, there was a child under the age of 15 in the vehicle

In Texas, a third DWI is a third-degree felony. The penalties for a third-degree felony include a minimum of 2 years in state prison and a maximum of 10. You may also be required to pay up to $10,000 in fines and have your driver’s license suspended for up to two years. You will also be required to have an ignition interlock device (IID) installed in your vehicle. This device requires you to blow into it to prove that you are sober before you can start your vehicle.

If you have two or more previous convictions for DWIs with a blood alcohol concentration (BAC) of .15 or higher, you may be charged with a second-degree felony. The penalties for a second-degree felony include a minimum of 2 years in state prison and a maximum of 20. You may also be required to pay up to $10,000 in fines and lose your driver’s license for up to two years. Your vehicle will also need an IID device.
